Do you think the Data Privacy Act of 2012 does not violate our freedom of speech and freedom of expression? Explain your answer.

Under the 1987 Constitution of the Republic of the Philippines – Article III, The Bill of Rights – Section 4: No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances.

Data Privacy Act of 2012 does not violate any freedom of speech or freedom of expression, rather it secures each one of us from being rediculed and stepped on by other person of this rights. We are free to say or express our selves in any way we’d liked to; yet isn’t it a bit over the line to engulf ourselves of “Freedom of Speech” and “Freedom of Expression” rights when we have violated other peoples rights as well?

What really is freedom of speech and freedom of expression, and to what extend is it limited to? I think the Data Privacy Act of 2012 puts a fine line to it, so we know at to what extend of rights we have and what consequences we would be facing if we cross that line.

Among the rights of a Data Subject, which do you consider as the two (2) most important rights? Why? Elaborate your answer. 

Lisedt below are the right of a Data Subject:

  • The right to be informed
  • The right to access
  • The right to object
  • The rightto erasure or blocking
  • The right to damages
  • The right to file a complaint
  • The right to rectify
  • The right to data portability

The rights of the Data Subject where created and lawed to what is needed to ensure the person gets treated equally wether guilty or not, to any accusation he/she is being questioned of. I believe these rights are equally balanced and needed to incorporate each rights and not by their own terms only. Thus, I see it all as important and needs to be considered rights of the Data Subject.

In Data Privacy Act of 2012, when do you consider a person as a Data Subject?
Provide an example situation.

A Data Subject refers to an individual whose personal information is processed. A good sample of a Data Subject is a person being held in trial; a person who is bein interrogated or questioned for acquisition of data(s) needed for a resolution/resolvement of questions.
